One antidote to moral distress is stronger moral agency—that is, an enhanced ability to act to bring about change. The Clinical Ethics Residency for Nurses, an educational program developed and run in two large northeastern academic medical centers with funding from the Health Resources and Services Administration, intended to strengthen nurses’ moral agency. Drawing on Improving Competencies in Clinical Ethics Consultation: An Education Guide, by the American Society for Bioethics and Humanities, and on the goals of the nursing profession, CERN (...) sought to change attitudes, increase knowledge, and develop skills to act on one's knowledge. One of the key insights the faculty members brought to the design of this program is that knowledge of clinical ethics is not enough to develop moral agency. In addition to lecture‐style classes, CERN employed a variety of methods based in adult learning theory, such as active application of ethics knowledge to patient scenarios in classroom discussion, simulation, and the clinical practicum. Overwhelmingly, the feedback from the participants (sixty‐seven over three years of the program) indicated that CERN achieved transformative learning. (shrink)

The 1981 Uniform Determination of Death Act (UDDA) established the validity of both cardio-respiratory and neurological criteria of death. However, many religious traditions including most forms of Haredi Judaism (ultra-orthodox) and many varieties of Buddhism strongly disagree with death by neurological criteria (DNC). Only one state in the U.S., New Jersey, allows for both religious exemptions to DNC and provides continuation of health insurance coverage when an exception is invoked in its 1991 Declaration of Death Act (NJDDA). There is yet (...) no quantitative or qualitative data on the frequencies of religious exemptions in New Jersey. This study gathered information about the frequency of religious exemptions and policy in New Jersey that was created out of respect for religious beliefs. Literature and internet searches on topics related to religious objections to DNC were conducted. Fifty-three chaplains and heads of bioethics committees in New Jersey hospitals were contacted by phone or email requesting a research interview. Respondents answered a set of questions about religious exemptions to DNC at the hospital where they worked that explored the frequency of such religious exemptions in the past five years, the religious tradition indicated, and whether any request for a religious exemption had been denied. This study was approved by the Northeastern University Institutional Review Board (IRB #: 16–03-15). Eighteen chaplains and bioethics committee members participated in a full research interview. Of these, five reported instances of religious exemptions to DNC occurring at the hospital at which they worked for a total of approximately 30–36 known exemptions in the past five years. Families sought religious exemptions because of faith in an Orthodox Judaism tradition and nonreligious reasons. No failed attempts to obtain an exemption were reported. Religious exemptions to DNC in New Jersey do occur, although very infrequently. Prior to this study, there was no information on their frequency. Considering religious exemptions do occur, there is a need for national or state policies that addresses both religious objections to DNC and hospital resources. More information is needed to better understand the impact of granting religious exemptions before new policy can be established. (shrink)

Ideas central to ethics—that happiness is the end of human endeavor, that moral virtue is formed through action and habituation, and that good action requires prudence—found their most powerful proponent in the person medieval scholars simply called “the Philosopher.” Drawing on their intimate knowledge of Aristotle’s thought, Robert C. What the moral theologian has to teach concerning the Sermon on the Mount depends fundamentally on how these words of the Lord are heard. With hearing comes understanding, and because this Sermon is considered in the tradition to be a kind of interpretative key to any understanding of the Christian life as such, the way one hears what is being said is critical to the formation and practices of faith in the believer. In an age determined by nihilism, this hearing (...) has been overtaken by the need to reassert the moral god, in consequence of which faith is reduced to its service in propping up an otherwise endangered morality, however variously that may be described. This is illustrated with reference to John Paul II's encyclical letter, Veritatis Splendor. What is lost through such an account is the hearing of this Sermon as a word of grace, from out of whose movement the hearer is prepared for the reception of faith and is turned out toward the future with God. St Thomas Aquinas's teaching shows how each use of grace is an event of appropriation wherein the believer is conformed to Christ, so that in one's understanding and making one's own of what is being heard, God is claiming His own. In 1947, Grace Murray Hopper a pioneer in early computing made an unusual entry into her daily logbook: lsquo;Relay #70 Panel F in relay. First actual case of bug being found.rsquo; Accompanying this entry is an actual celluloid tape encrusted bug, or more specifically a moth, fastened to the page of the logbook. According to Hopper, one of the technicians in her team solved a glitch in the emHarvard Mark II/em computer by pulling an actual insect out from between (...) the contacts of one of its relays. Word soon went out that they had lsquo;debugged the machinersquo; and the phrase quickly entered our lexicon. After languishing for years this mythic moth was eventually transported to the emSmithsonian/em where it now lies in archival state. The mothrsquo;s dynamic vitality had introduced a kind of surplus or aberrant code into the machine, which in effect pushed the machine towards a state of chaos and breakdown. Its failure to act as desired, to perform the coding sequences of its programmed history suggests that even a seemingly inert or lifeless machine can become lsquo;more and other than its historyrsquo;. Hopperrsquo;s bug is thus a material witness to the creative co-evolution of the machine with the living matter of the moth. Moreover, as a cipher for machinic defect the bug reminds us that mutations are in fact necessary for systems to change and evolve. The crisis introduced into a biological system or machine through the virulence of the bug is terminal only to the extent that it becomes the source for another kind of order, another kind of interaction. This is used as a casenbsp;study to argue that chaos is not only an animating force in the constitution of new systems but is necessary for the evolution of difference. (shrink)

The conclusion of Marcella Althaus-Reid and Lisa Isherwood’s 2007 book, Controversies in Feminist Theology, noted that ‘The future of feminist theologies are assured while gender and sexual oppression exist’.1 Yet, they also spoke of a number of challenges to the field, specifically difference in methodologies, varied nomenclature and terminologies, and stereotyping among its practitioners. I would add another: that the nature of bias itself is not uniform nor homogeneous but is largely treated as such by contextual theologians. In this article (...) the challenge presented by the presupposition that ‘a bias-is-a-bias’ is addressed from an epistemological one that attempts to delve into the nature of bias, beginning with the question: if the root nature of the problem, that is bias, is not homogeneous but rather reflects the interplay of different types of biases, does not gender oppression call for more comprehensive solutions beyond solidarity or justice? While justice-based solutions called for by feminist theologies are certainly valid and necessary, perhaps they function more as short-term solutions to a much larger dialectic, one that requires a more comprehensive grace-based approach. Grace and Freedom in a Secular Age offers a concise exposition of key ideas - contingency, otherness, freedom, vulnerability and mutuality - that inform the work of the Canadian philosopher Charles Taylor, especially concerning the dynamics of religious belief and religious denial in what he calls a "a secular age." Only human beings have a rich conceptual repertoire with concepts like tort, entropy, Abelian group, mannerism, icon and deconstruction. How have humans constructed these concepts? And once they have been constructed by adults, how do children acquire them? While primarily focusing on the second question, in The Origin of Concepts , Susan Carey shows that the answers to both overlap substantially. Carey begins by characterizing the innate starting point for conceptual development, namely systems of core cognition. Representations of core (...) cognition are the output of dedicated input analyzers, as with perceptual representations, but these core representations differ from perceptual representations in having more abstract contents and richer functional roles. Carey argues that the key to understanding cognitive development lies in recognizing conceptual discontinuities in which new representational systems emerge that have more expressive power than core cognition and are also incommensurate with core cognition and other earlier representational systems. Finally, Carey fleshes out Quinian bootstrapping, a learning mechanism that has been repeatedly sketched in the literature on the history and philosophy of science. She demonstrates that Quinian bootstrapping is a major mechanism in the construction of new representational resources over the course of childrens cognitive development. Carey shows how developmental cognitive science resolves aspects of long-standing philosophical debates about the existence, nature, content, and format of innate knowledge. She also shows that understanding the processes of conceptual development in children illuminates the historical process by which concepts are constructed, and transforms the way we think about philosophical problems about the nature of concepts and the relations between language and thought. I develop and defend the view that subjects are necessarily psychologically able to revise their beliefs in response to relevant counter-evidence. Specifically, subjects can revise their beliefs in response to relevant counter-evidence, given their current psychological mechanisms and skills. If a subject lacks this ability, then the mental state in question is not a belief, though it may be some other kind of cognitive attitude, such as a supposition, an entertained thought, or a pretense. The result is a moderately revisionary (...) view of belief: while most mental states we thought were beliefs are beliefs, some mental states which we thought were beliefs are not beliefs. The argument for this view draws on two key claims: First, subjects are rationally obligated to revise their beliefs in response to relevant counter-evidence. Second, if some subject is rationally obligated to revise one of her mental states, then that subject can revise that mental state, given her current psychological mechanisms and skills. Along the way to defending these claims, I argue that rational obligations can govern activities which reflect on one’s rational character, whether or not those activities are under one’s voluntary control. I also show how the relevant version of epistemic ‘ought’ implies ‘can’ survives an objection which plagues other variants of the principle. (shrink)

From the traditional point of view, power and truth are not related. Since 20th century there has been a social and historical breach in conventional assumptions about the relationship between power and truth. On one hand, it is generally accepted that scientific facts are considered artificial, in the sense of being constructed. This assumption neither implied any kind of fraud nor did it mean that they could be created ex-nihilo. But the interpretation of Kuhn as well as the subsequent developments (...) of the Strong Programme, successfully postulates that truth is merely a social issue. Since then, it has been increasingly suspected that any objective or neutral description of society is too difficult, rendering it completely illusory. That is why it is necessary to ask again for the relation between the structures of truth and the social structures of power and what kind of impact they have on contemporary sociological theory. In this paper, it is given two examples of that kind of enterprise related to two major leading sociologists: Bourdieu and Giddens. Desde el punto de vista tradicional, no hay asociación entre poder y verdad. Pero desde el Siglo XX existió un quiebre social e histórico en las presuposiciones convencionales acerca de la relación entre poder y verdad. De un lado, en general se acepta que los hechos científicos son artificiales en el sentido que son construidos y se asume que esto no implica algún tipo de fraude ni significa que ellos son creados ex-nihilo. Pero la interpretación de Kuhn, así como también los desarrollos posteriores del Programa Fuerte, permite postular que la verdad es un asunto puramente social. Desde entonces, se ha sospechado cada vez más que cualquier descripción neutral u objetiva de la sociedad es tan difícil que llega a ser completamente ilusoria. Por eso, es necesario preguntarse nuevamente por la relación entre las estructuras de la verdad y las estructuras sociales del poder y qué tipo de impacto ellas tienen en la teoría sociológica contemporánea. This paper will suggest a mapping for human dynamics to see where emerging digital technology currently and could further affect the dynamics of the human, technological and natural, and the cultural forms that define them. Emerging technology will be seen to reveal and surpass the limitations of human measures built on human abilities and perception. and the social structures that are derived from them. The formation of this conceptual mapping is based on the premise that digital technology has the ability (...) to better relay and hence refine dynamics working at points where culture is created and necessitated in our perception of a shared reality. Technology thus alleviates the layering, representation, labelling, and reification notions of culture that are based in human perceptual limitations. Information as referential will be seen against the tendency of technology to offer succinct mediation and direct actions as a format for any change and application with refined cultural constructions. The mapping presents a notion of homeostasis or more bereft of balance at the point where the proximal dynamics of the unit, that is, the individual, is closely supported by the technology with a changing orientation to the dynamics of a natural environment. The notion of a person as an individual is also reconsidered in terms of technology and how this changing definition is part of how we conceptualize a balanced world. Nonlinear mapping rendered in a complex will be introduced to align these mixed dynamics. Complex is here defined as a concurrence of dynamics evident in shifts of change that act as a whole and where each action affects the whole. As measures are revealed so, too, will be the source of notions of linearity and nonlinearity; mapping; point of view as a basis of complexity; and evolutionary theory as a function of a labeling of cultural dynamics. Summary Analogue models are actual physical setups used to model something else. They are especially useful when what we wish to investigate is difficult to observe or experiment upon due to size or distance in space or time: for example, if the thing we wish to investigate is too large, too far away, takes place on a time scale that is too long, does not yet exist or has ceased to exist. The range and variety of analogue models is too (...) extensive to attempt a survey. In this article, I describe and discuss several different analogue model experiments, the results of those model experiments, and the basis for constructing them and interpreting their results. Examples of analogue models for surface waves in lakes, for earthquakes and volcanoes in geophysics, and for black holes in general relativity, are described, with a focus on examining the bases for claims that these analogues are appropriate analogues of what they are used to investigate. A table showing three different kinds of bases for reasoning using analogue models is provided. Finally, it is shown how the examples in this article counter three common misconceptions about the use of analogue models in physics. (shrink)

In this paper, I take up the conciliatory-steadfast debate occurring within social epistemology in regards to the phenomenon of peer disagreement. I will argue, because the conciliatory perspective al-lows us to understand argumentation pragmatically—as a method of problem-solving within a community rather than as a method for obtaining the truth—that in most cases, we should not simply agree to disagree.

In this book, Abraham argues that a theological imagination can expand the contours of postcolonial theory through a reexamination of notions of subjectivity, gender, and violence in a dialogical model with Karl Rahner. The purpose of this scoping review is to investigate the value of creative arts therapies in healthy older adults. This article aims to shed light on current knowledge concerning the effectiveness of art therapies for the prevention of common age-related conditions using the definition of art therapy provided by the American Art Therapy Association, as well as Cohen’s conceptual framework for the psychological conceptualization of the relationship between the arts and health in later life. The objective is to carefully capture (...) subthreshold situations of distress, which are often not taken into account and primarily involve psychological aspects that are crucial in the multidimensional perspective of healthy aging. Twelve articles were selected and examined following an initial electronic search on 3 databases. A thematic analysis of the results identified four major themes: improving cognitive performance and proprioception; enhancing self-identity and meaningful life; reducing feelings of loneliness and depressive symptoms; and the importance of socialization. All these aspects constitute the basis for preventing psychological distress and enhancing mental well-being for healthy aging. (shrink)

Most of the existing natural language processing systems for legal texts are developed for the English language. Nevertheless, there are several application domains where multiple versions of the same documents are provided in different languages, especially inside the European Union. One notable example is given by Terms of Service (ToS). In this paper, we compare different approaches to the task of detecting potential unfair clauses in ToS across multiple languages. In particular, after developing an annotated corpus and a machine learning (...) classifier for English, we consider and compare several strategies to extend the system to other languages: building a novel corpus and training a novel machine learning system for each language, from scratch; projecting annotations across documents in different languages, to avoid the creation of novel corpora; translating training documents while keeping the original annotations; translating queries at prediction time and relying on the English system only. An extended experimental evaluation conducted on a large, original dataset indicates that the time-consuming task of re-building a novel annotated corpus for each language can often be avoided with no significant degradation in terms of performance. My strategy is to examine a recent trend in philosophical discussions of responsibility, a trend that tries, but I think ultimately fails, to give an acceptable analysis of the conditions of responsibility. It fails due to what at first appear to be deep and irresolvable metaphysical problems. It is here that I suggest that the condition of sanity comes to the rescue. What at first appears to be an impossible requirement for responsibility---the requirement that the responsible agent have created her- (...) or himself---turns out to be the vastly more mundane and non controversial requirement that the responsible agent must, in a fairly standard sense, be sane.
